We live in Virginia.
My husband's ex wife is suing him for non-payment of some college expenses for their children that is outlined in their divorce decree.
The decree states that husband is responsible for 1/2 of college tuition & fees, room & board, and transportation arising out of a 4 year degree.
Husband HAS paid 1/2 of tuition & fees, and gives daughter a little money every month for gas.
He has not paid, as requested by his ex, Room & Board. The children live her home and attend Community College (2 year school) with INTENTIONS of transferring to local university (and still live mother's home).
Mother came up with a figure to "charge" husband by contacting local university and getting what THEY charge for room & board, and she split that in half. Husband (and I) interpret the decree to mean that if the children go off and live at a 4 year university that husband should pay Room & Board, not if the child lives at home.
If paid, this money would be going to Mother, not children. Child support has officially ended on both children in question. In other words, she no longer receives any money from Husband ~ except for reimbursement for health insurance until the children are taken off her policy.
We are awaiting the lawyer to call us back, but hasn't yet. So, while we're waiting, anyone have any opinions or facts to share?
