I live in NJ and when my child support was first issued I lived in PA
Currently the case is still in PA and both parents have lived in NJ for 5+ years. I was divorced in 2000 in NJ and have not received child support in over 7+ years. My ex recently filled to be exempt from paying child support while he was incarerated (3 of the 7 years)in NJ on drug charges and was relieved of paying over $11,000.00 in back child support. Can you tell me what the law states in PA and what the statutute number on that law is(why does he not have to pay if he was in jail)? Currently I'm appealing this decision. My divorce states that while he was in jail that the support was to remain in effect. The divorce is a court order from NJ. Why doesn't PA have to honor the original order in their court and the divorce decree from NJ? Also the divorce stated that he was to supply medical benefits and pay all medical bills as well as obtaining life insurance naming the children as his benficiaries. He has not done this. PA will not release this support case over to NJ without dropping all previous support owed. What can I do?Do I need to go to court in NJ to over ride PA decision?Thanks for any help you can give me. If your ex is in jail how do you expect him to pay?
they dont have jobs in jail and he dose not receive any money to be there, so how do you expect him to pay???????????

why should he be exempt from paying for being in jail? The child is still there, and still needs to be supported. That child does not suddenly not need anything the CP has to provide one hundred percent of just because the NCP screwed up. And not trying to be mean or anything, but "dose" is spelled "DOES"

Mary, I am sorry I don't have anything to offer you, other than hang in there, and keep fighting it. He should have to pay what he owes you, and he does owe you, even though he was in jail. Good luck!!!

All I can tell you is where I live the NCP is not responsible for paying child support while incarcerted. You could go to your states web site and PA's to look up their laws or you could try calling the Attorney General in both states and asking them.

shouldnt be exempt....

mississippi--the NCP should not be exempt for court ordered CS. are you receiving assistance from the state you live, and did you receive assitance during the years/or the time NCP wants to be exempt? If so, the state shouldnt expect to receive their benefits back to them if he has been exempt...Be sure you exhaust all leads and ask several questions to your worker...you can also get legal aid if you feel you are being given wrong info. good luck--let me know how it [email protected]
