I live in California. I have purchased an item from a person from Florida. I sent him the money but I never got the item. I would like to take him to small claim court, but he lives in Florida and I'm in California. Can I do small claim suit in writing or phone without actually being in Florida? Or can I file the suit in California?

Nope. One of the risks of interstate commerce.

Sue in Florida. That way if you win, you can use FL laws to enforce the judgment on their Florida assets.
