I really hate my mother and I am in the process of suing her. She found out that I had an abortion by going into my records while she was at work (she is a nurse). She led me on for 4 months, and then she told my Dad. I am 20 years old now, a legal adult. My Dad was upset, and he is giving me money to do this suit. She says that she cares about me, and that is why she told him because I live with him. Her attorney and the hospital attorneys are now digging up things about me and my past. I have had some problems in school and with the law, which are all coming out in these depositions. I am claiming punitive damages and emotional distress. I have not lost any income, and I have not yet sought counseling, but I plan on it soon. I want to go after the health plan and my mother for whatever they got. They did me wrong and they should pay me and pay dearly for violating me. What do you think I can get from them? I want the maximum the law allows. I live in California. Also, can she avoid paying me if she declairs bankruptcy. As far as I know, she has her retirement and not much else. Also, the other attorneys are extremely tough, but I want to WIN!

I was just curious. Are you going thru this lawsuite because it is your mom who caused you this stress or because your rights to privacy was violated? Since you live with your father (and he is giving you the money to pursue legal action)is sounds like you don't have a good relationship wtih your mom. You need to take your mom out of the picture and look at it as an employee of the doctors office or hospital violating your rights to privacy. Additionally, I can't imagine that your past trouble (with the law/police) would be any bearing on your right to damages as a result of their actions. Do you have an attorney that is handling this for you? What does your attorney say about the other side drumming up dirt on you ? I would imagine it is against the law in any state for any medical provider to release information without your permission, especially if you were an adult at the time of your abortion. Also, have you contacted the doctors office/hospital where she works at? I can't imagine them not firing her ass for something like that. I hope you are doing this for the right reasons, and not the wrong. I agree she had no right to tell your dad... I wish you much luck in this situation.
