What is the name of your state (only U.S. law)?
New Jersey

3 months ago, I signed a contract for an investment opportunity that I would pay 1000 and receive an amount after 90 days. The 90 days has passed, and the person will not return my phone calls, and messages over the past week. Yesterday he sent me a brief message saying he has been sick and Ebay is holding his money. He still continues to not return my calls or messages, even after he asked me to contact him back yesterday. I called his references he provided, and of course they all gave good reviews of the man.

Take your contract to a local attorney. That is, literally, the only thing we can advise you to do.

Should I send him a final message, or just let an attorney deal with this?
You can send him a final message saying you are letting your attorney deal with it.

You should have a copy of the contract available for the attorney to review. With investments, sometimes you will make money and sometimes you will lose money. I think you lost money (i.e., your full $1000).

Thanks. I have tried to offer to take payments, but I have two contracts signed by the man. Both say the same thing, that if I invest 1,000 in products, then after 90 days $5,000 would be paid out to me. He offered the same scenario two years ago; and I didn't sign up for the deal. People acted like it was a good thing. But apparently it is not.
