I was working with a contractor to get bids on a new home construction. I gave the contractor pictures of the plans that i was interested in and a few days later he told me that the project would be more expensive than my budget, but he wanted me to meet with "his guy" to see if we could get it more manageable. The contractor scheduled the appointment, and brought the architect to my house at the designated time, introduced us and sit in on the meeting discussing wants and needs. I did meet the architect one more time with out the contractor present at a Hardees to talk about some changes that i would like to see if we were going to in fact build the house.

After I received some preliminary quotes from the contractor and have decided to go a different route and different contractor. So we have started over getting quotes from another contractor with our original plans/drawings that we found.

3 months later we receive an invoice from the architect for "house plans" that we never received or used. I thought this entire time he was working for the contractor as the contractor was trying to get our business. At no time did we ever discuss cost or previous work or references with the architect. Every correspondence between us was also directed to the contractor not just us.

I just feel like I am getting billed for something that I didn't want, request or even know I had purchased.

Any ideas on how liable i would be for these services, I talked to the architect directly and he is adamant about verbal contracts and that he doesn't care who pays me, as long as he gets paid and says that if I have a problem it is with the contractor and should get him to pay me for his bill.

YOu didn't want the house plans? Where are the drawings now? Did you have a contract with the contractor? Did you ever receive copies of the plans? (Even in email?)

I wanted the contractor to build a house within a predetermined budget and we had ideal plans already, and was under the impression that the contractor was providing this architect for his assistance to secure/retain the job.

The plans are not completed and are still with the architect. Last communication that we sent said they were still not exactly what we were wanting to have built

No contract with the contractor, just getting bids for the construction and options, and he brought the architect into it.

I did receive pdf copies of 2 floor plans with elevation via email that were sent to both of us myself and the contractor.

Thanks for your input on this!

Did you happen to ask if he billed the contractor and if the contractor indicated why he wasn't paying?

He said had I hired the contractor, it would have been billed as a line item. But, since I am not using said contractor, he had to get paid for the work he'd done somehow. So I got invoiced.
