I am a legal stranger in the case, but am posting this to find out information for my friend who is currently in a detention center. He is currently serving 6 months for Flagrant Nonsupport (Feb. 08) but I was told that the charge was amended to Nonsupport by the jailer. (I have a copy of his criminal history but it was ran in June 2007.)
BG - He is still married to his wife - no legal separation nor divorce pending. I know stupid as it's been that way for 7 years.
Mom is now telling him (via his mom) that she is going to seek termination of his rights due to his incarceration, that flagrant nonsupport is a felony, not providing support, his past DUI convictions (he's had none in the past 8 years), etc.
I've been reading statutes for involuntary trp and I'm just getting confused. I helped him research some years ago as she is always asking him to voluntarily sign his rights over. Something he doesn't want to do. And told her so and that no judge would accept him doing so without a step-dad willing to step in and adopt.
Question - is it possible for her to do so?
