What is the name of your state?TX
involved in Accident on 2-11-05, her fault. Put in Claim with her Insurance.
They say they can't get me a Rental Car until she claims liability, but they cannot get a hold of her.She is a Minor and the Insurance is under her Grandmothers name.They have spoken to Grandmother who said she would make Granddaughter call Insurance but she hasn't. :( My Car is totalled. Whatsteps can I take to get this moving faster, It's the only Car we had.

The insurance co. will not take any action until they are able to talk to their insured to get a statement. This is standard procedure. Hopefully they can get a hold of her soon. After all the insured has a duty to cooperate w/ their insurance co. If she doesn't then her policy will be cancelled.

Keep bugging the insurance company.

Can I make them reimburse me for the time lost from work and rental car if it takes them long?

No, because you have no contract with the insurance company; you are a legal stranger to them.

Sue the people who hit you: kid, grandma, mom, dad, dog, everybody in the family. Let the judge sort it out.

Can anyone help, I have been patient and waiting for the person that I was in an accident with to call Her Insurance to claim liability, my car is totalled and no rental car.she is 16 and when I went over to her house I talked to her Mom and she said she would make her call, which hasn't happend. I have the police report and she even got a ticket for failure to yield so why am I stuck out until they the insurance has her statement they wont pay up. Are they giving me the runaround. There has to be something I can do to legally or am I just gonna have to wait until this 16 year old wakes up?

Does the cardealer have to tell you if the car you want to buy has been in a wreck or is it up to you? And if so can you try to have them go down on the car payments. Since my car was totaled and the insurance says it's value is 3700 dollars and I still owe 4700 on it. All in all I payed 7000 dollars for it.

A: Car dealers are supposed to tell you but they don't always tell you.

A: This happens frequently when a car is underinsured.

Take the driver and the owner of the car to small claims court. Check w/ the clerk in your county to find out the $ limits first. This is your only option if the insurance co. refuses to settle.

As far as the value of your car the insurance co. will only give you fair market value. If there is a lien on the car you would unfortunately be responsible f/ the balance.

If the insurance does settle and since they only want to pay me about 3700 dollars can I make them find me a Car similar to my old one, to see if they can even find one for that amount?

A: No, the insurance company won't do your car shopping for you. All they will do is give you the dough.

Ok, now the Insurance wants to go ahead and settle the claim without their insureds statement,they got the police report and my statement and they say that she is at fault. I talked to them and they said that since it's a total loss that a total loss ajuster will contact me, don't I have the right to a Rental car now that they admitted fault until I get the money for my car?
