What is the name of your state (only U.S. law)? California.

Hi there. I own a business that sells a study guide online for a particular exam. (A PDF + Audio Guide). One of my latest customers told me she already has the same material, which she had purchased off of Ebay.

She pointed me to the auction page, and someone is selling my exact guide, word for word, for their own profits on Ebay. I am furious, but I would love your advice on how I could take legal action regarding this matter, assuming I have a case (which I do, right?)

Please help. Thank you.

First, go to Ebay and down load the forms to file a VERO (DMCA) complaint.
The first one you must sign and fax back to them. This will get the auctions taken down promptly.

As for monetary damages, typically your lawyer will send a demand letter, and if that doesn't work, start a lawsuit. If you are getting ready to due, registration of the material with the copyright office would be probably a good idea.
