What is the name of your state? TX I am a US citizen working for a korean company in korea. My wife is from the philippines. We had our interview for her visa and it was denied. We were told it was due to the fact I am working here and she cannot go to the US by herself. My contract ends in 7 months. I need to show a plane ticket or evidence i have finished my work here. I also need a joint sponsor since my income here is not US based, even though it is above the 125% poverty guidelines. We have been married 2 years..what can we do? Is this policy correct? What was purpose of going through whole interview if policy was clearly defined? and no refund of $380!

From your post it sounds like you know exactly what needs to be done: you can reapply once you have a clear picture of when you are returning to the US by way of return ticket, transfer, etc., and you know that you need to have a co-sponsor for purposes of signing the affidavit of support. The purpose of the interview is to determine eligibility since the consular officer has no way of knowing what your plans are or family situation is unless and until he/she interviews you.

Seriously.

I just read your past posts and I am not surprised at the result of your wife's interview. All of that information is available before the interview and it is your job to go in prepared. You walked in practically asking for a denial.

I hope you have told your wife about the warrent for your arrest, so she will not be surprised if you are detained when you enter the US. If you had petitioned in the US, this would have come to someone's attention--I actually wonder how it did not come up in the fiance petition you filed, but I didn't read your whole story. Using the Consular process to get around USCIS might have some very interesting outcome posssibilities.

Then again, maybe the interviewing Consular did a really, really good job and has it figured out.
I wonder why he wants a refund of the fees?

Enough inspiration around here for a hundred novels, if I ever had the time...
