I am divorced in Indiana and per the decree my ex-husband can claim one of the two children on his tax return each year and I claim the other. He is also court ordered to not consume alcohol in any form when he has the children for his visitation and he was also to get an alcohol evaluation by a a therapist and abide by whatever was recommended. He has been through rehab. 3 times and still has not beat the alcoholism. He continues to drink with the kids thus I changed his visitation on my own to one day a week and I pick them up at the end of the day. He also has them one evening a week. They do not spend the night with him. Do I need to use an attorney and go through the courts to get to claim both children on my taxes or can I just write them both in? My ace in the hole so to speak is that he has not gone for the evaluation yet (it's been 3 years) and is still drinking. His support is being paid and is current though it is his dad who pays the support for him. I need every bit of help I can get to be able to provide them with a house etc. and claiming both would help a lot. I do claim both on the Earned Income Credit form.
