Is common law marriage void

At the time of my pregnancy, I was living with the father of my son for 4 months. Then he was sent to prison, I was told that we could not get contact visits because we did not have any proof that we were ever married and that the only way we could get contact visits is if I showed proof of common law marriage. So I got a paper notarized stating that I state myself as the legal wife of this man in the State of Texas and sent it to the Department of Corrections where he was located. We only lived together for 4 months ever and once he was released from prison we never lived together again. Is this common law marriage legal? If so, how do I go about terminating this marriage so that it doesn't come back and explode in my face once I am ready to actually get married legally?
