In Colorado... is email between two people sitting on a board of directors private? What if One party finds that the other has forwarded it and misused it?

The receiver of an e-mail is the owner and may do with it as he/she sees fit, including taking out a full-page ad in the NY times.

My response:

Depends on the content. Was it "Board" business e-mail, or was it a private communication? However, in the main, like a standard letter, once an e-mail is sent, it becomes the property of the recipient - unless there's a specific privacy statement stated in the e-mail; e.g., "This e-mail is private, and shall not be re-published to third persons." However, that's still not a guarantee.
