just recently divorced after 1 year seperation. i have an insurance check for my refund on prescriptions and it's in ex-spouse name. he refuses to sign it. in our agreement we are free from control, restraint, interference or authority of each other. also not to harass, molest, disturb or malign. i also have possession of the house and he has no interest or rights to it. he wouldn't sign a lease for gas drilling unless the checks were made out to both of us. i'm from west virginia. is he legally able to have this "control"? i see this as harassment and control. i'm considering on sueing him over these problems.

Usually there's a clause in the settlement agreement or decree stating that each will cooperate w/the signing of any necessary papers.

If that's the case, go back to the original court and ask for a contempt hearing.

The court will not be happy about his lack of cooperation and will most likely order him to pay your attorney fees associated w/this silliness.
