I'm from the state of TN.

Hi folks,

I'm in the process of getting ready to launch an internet radio/and Youtube video show that offers dating advice. I'm also in the process of setting up a business website where I plan on selling a self-created monthly, email newsletter through Paypal.

The plan is to give site visitors a chance to support my dating advice show giving different choices of what they'd "like" to pay as a subscription for my email newsletter. However, no matter what they decide to pay me--------each customer will get the exact same product.

This will all be above board, as I will clearly state that it is the same product, and that it is up to them what they'd like to pay to recieve it.

For example: I would have Paypal "SUBSCRIBE" buttons listed on the website with designated payment amounts like $20, $50, $100.

Here's a website I found through Google that is an example of what I mean. But it seems to be some kind of a nonprofict site and NOT a business site:

Support the Secular Web!

My questions are:

1. Is it legal to sell email newsletter subscriptions using the SUBSCRIBE button this way as a business (instead of as a nonprofit organization)?

2. Is there a way to sell another item (like an mp3 download) and let the people pay me whatever they decide for it? What I'm trying to do here is find a way to give back to the show without limiting them with the amount of they'd give. In effect, I guess what I'm trying to do is take donations without actually calling them "donations".

Any info that any of you may can provide would be appreciated.

Thanks!

Generally it's legal to sell your own material (make sure your MP3's aren't using illegally copied background music) at various prices. I'd avoid using the word donation or anything giving the illusion that you're operating a charity rather than a for profit business. However, you're pretty much doing what the "shareware" industry does.

Hey, thanks for responding FlyingRon.

Yes, all of my products will be orignal creations. The mp3s as well as the subscriptions.

And yes, I will NOT put the word donation anywhere on my site. I will clearly state that the email newsletter that they are subscribing to is the same product--------and I will encourage the subscriber to pick whatever price that suits them.

By the way, do you or anyone know of a particular shareware company that does this sort of thing? I'd be good to see an example of just how they're doing it. I may be able to fashion my webpage after theirs.

I'll try looking up some myself and see what I can find.

Thanks again.
