I was awarded primary custodian in the joint custody of our son during the divorce. A year later I turned my son over to my ex-husband due to threats and the fact that at that time (since he was not paying child support and I had a huge lawyer bill from taking him back to court) I could not afford both children (one is not his). His lawyer did a modifaction so that my ex-husband was primary custodian. Now that I am married I would like to seek primary custodialship back. My ex-husband is not married, however he is living with the mother of his new child. He makes visitation hard for me. I live in Key West, FL and it is hard to see my son more than at Christmas and summers. Springbreak is out of the question because my ex fills like this is his time. He does let me get my son for 4 weeks during the summer. My son has also expressed intrest in living with me, however he is only 9. My question is- Do I have a chance in court of getting custody back?
