What is the name of your state? AZ

Is it possible to change judges and if so how can I go about doing that? I have a trial coming up in December regarding dad being in contempt of court, custody and child support and I pray everyday that they give my case to someone else.

The judge approved the petition for contempt of court for child support (dad is $11,000 in arrears after only 2 years), approved the motion to continue trial and approved the motion to consolidate the child support hearing and custody hearing. However the judge denied my request for a custody evaluator (dad is trying to get joint custody 50/50)? After approving the other requests what are some reasons a judge would deny a request for a custody evaluator (and I know one petition or request has nothing to do with the other but just curious why the judge denied one peition but not the others)?

Any thoughts why judges approve or disapprove custody evaluations?

There are LOTS of reasons, some valid, some not, on why a judge rules as he/she does. There is simply no way that anyone on this forum, who is not privy to ALL the evidence and testimony can guess why a court rules as they do.

And in answer to your other question, you cannot just change judges. Unless there is some reason why the judge should be removed -- he is married to or has a blood familial relationship with either attorney or party, or he has done something unethical or interferes with justice. Ruling against you IS NOT reason to get a judge removed. It happens.

So dad is in contempt of court.
Dad hasn't paid child support.
Dad wants 50/50 custody so he doesn't have to pay as much or any child support.
You file for a custody evaluation so you have more leverage.
The judge consolidates the cases to same time and money.
Custody evaluations cost thoudands of dollars which have to be paid up front by both parties and someone is always angry.
If dad isn't paying child support already...
Do you see where the judge is coming from in denying the custody evaluation right now?

And I would guess that since Dad hasn't been paying or seeing child regularly~ and judge already ruled in favor of Mom's allegation of Contempt...that the judge doesn't NEED a custody evaluation to tell him who the more 'fit' parent is.

BTW~ Nice to see ya around again rmet.:)
