What is the name of your state (only U.S. law)? FL

Is it routine to subpoena Defendant's neighbors in auto accident/Personal Injury cases? If so, will this type of useless persecution reflect negatively on Plaintiff, who by the way, is a BIG trucking Co?

not sure if its "routine" but its not out of the ordinary depending on what they are asking for.

i dont think it will look badly on them.

Yes, I think that's the point: we don't know what the use of talking to our good neighbors about us would be, specially when they will only fortify our case. That stated, we still don't want our neighbors to undergo this kind of persecution....it seems like this type of needless persecution would backfire on an agressive Trucking company which caused a "horrific" accident to begin with.

Aggressive, persecution and horrific are emotion-laden words, but none of those change the fact that the trucking company has a right to defend themselves. For whatever reason, they apparently believe your neighbors can shed some light on a disputed issue or provide some other validation. You believe your neighbors will "fortify" your case, so stop thinking of it as persecution. It's not; it's simply part of the legal process.

If the trucking company (or its employee?) caused the accident, why is the trucking company the plaintiff?

its called discovery. they need to know what you are presenting on your side so they can present your side. you can subpoena stuff from them that is relevant.

it wont look badly on them.
