Is it time to change custody?

What is the name of your state? CO
My ex hubby got a DUI after driving home from the bar Friday night. Our son is 6 and was left home with his cousin. This was during his parenting time. Our current schedule is he gets every weekend starting friday after school ending monday morning at school.

He had a DUI in 1994 and a DV charge in 2005 (took deffer so no conviction). Should I be getting a lawyer and request supervised visits? I really dont have money for a lawyer I just need to know what I should do at this point? I'm still kind of in shock because I thought he had stopped drinking as much. Do you think this is enough to show he has an alcohol abuse problem and to change custody? He took alcohol classes in 2005 but i guess it didn't help.

No ...This isn't enough to get supervised visits. The child wasn't in the car and was supervised properly. He hasn't even been convicted ...just charged.

Not to mention that DUIs 13 years apart doesn't exactly show a history of alcohol abuse OR behaving irresponsibly.
