What is the name of your state (only U.S. law)? Oklahoma
Is it to late to file a suit against the person that stole & totalled our pick up in 2008? Insurance didn't totally pay what we owed or for any aftermarket items or contents of the truck. We took a huge loss on the truck. We had considered filing suit then but the kid was in the hospital so we let it go. Now our insurance is not going to be re-newed due to hi risk. This is the only claim on it that wasn't an act of nature. All other claims have been for hail damage.

You can't sue him for the loss on your loan, that's not his fault. If you can prove the value of aftermarket items or contents that were not reimbursed by your insurance, you can sue for that. SOL for property damage in OK is 2 years.
