I'm hoping to find out if this is worth filing small claims in NC. I contracted with a photographer to take 6 month photos of my little girl. 3 months later, I still have not received them, but after lengthy needling and broken promises to mail them/meet me before, she's promised to meet me and deliver them today. Of course, I can no longer use them, as they're 3 months late and she's a whole different kid at this point. I'd like to get my money back ($200) on principle, but I don't know if because I'm actually getting the photos (although 3 months late), that constitutes a completed contract. Thoughts? I know it's such a small amount, but it's the principle of the thing.

Isn't the whole point of taking formal portraits at specific ages is to have a record of what the child looked like at that age? Therefore why would it matter that "she is a different child" now? Don't you still want to have that six month old record?

If they are pageant shots, OP would likely need to demonstrate the time requirement was met by having another photographer do them.
