hi my question is i live in las cruces new mexico and i want to know is it legal to ask for first months and last months and also a cleaning deposit i have heard from different court shows judge judy and so on that it is illegal to ask for all three sums. please let me know as i have already paid the 1st and last months rent and im moved in and im suppose to pay a cleaning deposit on the first.thanks for your time!!!!

Well what does your lease say?

If you signed an agreement that states you owe a cleaning deposit...well YOU SIGNED IT and YOU OWE IT!

If its not there in the lease, then they have no right ot demand the money from you, or threaten you with eviction..Its their mistake, not yours!

Here we have "mary hartman" (aka dj, aka dj1) back to his old instability.

He thinks that everyone follows NY law. You need to check NM law.

dj1 thinks that whatever is in the lease is ok, and that you don't need to do anything that is not in the lease.

Well, just as an example, california limits the amount of security deposit that landlord can take, and that overrides anything that is in the lease. dj1 can't understand that.

many states allow first month, last month, and also security deposit, other states handle it differently. Some landlords want deposits before the lease is signed.

This fact that different states have different laws has been pointed out many times to dj1, also to dj, also to mary hartman, but they are unable to grasp the concept. I think that dj under any name is mentally unstable.

Please note that Judge Judy is correct but the caveat is that Judy adjudicates based upon the laws of only one State. Hers. Therefore, if you live in any of the other 49 States that her courtroom is not located in, the L/T laws may differ.

That is why any landlord or tenant that has a question with respect to the written lease, must read the terms and conditions in that written lease AND the applicable State Statutes pertaining to the applicable L/T laws.
Verbal leases must also follow the State Statutes.

If anything in the written lease is contrary to State law, then State law applies.
