Sorry this is long:
I live in a mobile home park in Texas. I've lived here for over 10 years, and never signed a lease (I moved here with my sister while I was a minor, she moved out 5 yrs ago and the name was never signed over into my name). I am renting a lot in the park and buying the trailer.
About 4-5 yrs ago the ownership changed and after our manager died we got a new one. For over 5 yrs the lot rent has gone up every year as much as it can. Last year it went up 3 times. One was the regular one, then they started charging us to read the water meters, then they raised it again so they can pay the maintenance workers. (They have 5 maintenance workers, most of who stand around all day chatting.) They also hire out when any work needs to be done: lights hung, lawns mowed, trailers cleaned, carpet put down)
About a year ago they started charging late fees. If rent is 5 days late they charge 25$, 10days=50$, 25days=100$. Times are hard on everyone, and I know a lot of people who have moved out because they can’t handle the rent here. This past yr my son has had 3 health related surgeries. He was scheduled for surgery Dec 7, but we had to postpone it because he ate a crayon and they couldn’t do the anesthesia. He then had surgery on Dec 16th. He’s been in a lot of pain and I haven’t been able to go out. I am now late, and am being charged 100$. I called the office the day we got home from the hospital and told them what was going on and that I don’t have the whole amount. I was told that I had to pay it or be charged the late fees.
Is it legal to charge these late fees? I never signed anything agreeing to them, not have I ever saw a lease or anything from the park. I don’t want to move right now, I just finished paying for the trailer and have nothing saved to move.
Also, does anyone know where I can file complaints to? The lack of caring for the park and putting children in danger by allowing convicts and drug addicts in the park, not caring for the roads making the hazardous for children and vehicles shouldn’t be allowed. Last yr my daughter’s bedroom window was shot out, and they acted like they knew nothing about the shootout (ours wasn’t the only home shot at). This was the first time we’ve ever had any problems like that. But for the past yr people have had break ins and things stolen from their cars. They also tore up my front yard putting in a trailer across from me and haven’t fixed it, though I’ve asked many times (I refuse to mow over it because I don’t want to break my lawn mower as the ruts are huge.

Late fees are legal and appropriate. Your fees are rather low. My tenants get hit with a $150 charge for being five minutes late and an additional $5 per day, more than six days late total through out the term of the lease equals a $150 rent increase. On the tenth cumulative day late, they are evicted.

Unless your states mobile home park laws have capped late fees for lot rents not much you can do but re arrange your budget to make sure you are not late. Its a shame that the lot has been allowed to go only month to month rent, you should learn what your states laws are for home owners who rent lots mobile home communitys , Damage to the lawn of the lot you rent , stop telling them (oral complaint ) send written complaint via certified mail stating your not able to mow that area because of the rut damage created by siting the unit across the road , Crime problems stop complaining to the management and file reports with the police. Your also free to review the original lease to see exactly what its terms are for the amount of notice to give to the park then begin to look for a new place to have your home moved to. Your medical situation at home is unfortunate but doesnt excuse lot rent being late, meter reading fees well if you are able to read meter your self do they not charge it ?

You'll find the proper procedure for repair requests. Make all requests in writing.

I'd request a copy of the lease, including written notifications of rental increases and late charges. Management cannot increase prices without giving written notice (tenant has the opportunity to pay the increase or move). Since you've been paying the increases for a while, you've got an established agreement to those changes. Refuse anything else that isn't in writing.

They probably can't produce any documentation, let them know that you will need a written lease agreement so there are no further misunderstandings.

It's doubtful they can charge you to read the water meter. I'd contact the local utility to find out about metering in trailer parks.

Are they charging you a fee for them to read the meter? I'm a little unclear about the metering. Does management charge you a straight rate for water or is it billed according to your usage?

This sounds like such a mess.

Last year we were given notice about them starting to charge a fee for reading the meters. In the past I guess they did it and charged us just for the water, but it became a hassel for them(I honestly don't know why they changed) so they started charging the tennents. I think it is just so they can pocket more money. I believe they charge a fee based on the parks usage, not per each unit.

Sub metering not only tells them how much a housing unit is using it gives them a exact number to bill a tenant for water sewer use but makes it alot more fair , when water is included many tenants think nothing of leaving a hose run while washing a car, or letting friends/or family members come over and run some wash once in a while if they cannot afford coin laundry. Years ago I knew a tenant in a building I also rented in who thought nothing of leaving the cold on the bathtub trickle all day long so kitty could have FRESH cool water when ever kitty wanted instead of filling a cat bowl and on hot days just adding some ice. That tenants choices because water was inc cost every one of the rest of us in building money. Having a tenant pay for water and sewer isnt about making money its about reducing waste and keeping rents lower. Meter reading fees are avoidable, some one has to do it with older style meters. ( if you were not aware , in many places city sewer rates are extremely high due to cost of treatment and repairs) Your city water dept can tell you what its rates are per unit for water and sewer and the correct taxes and other fees , this way your free to do the math and see double check what you are being charged.
