I live in New York. My mother passed away a few weeks ago and in her will (written 2 years ago) left everything to me, intentionally making no provisions for my two sisters (they had a long history of borrowing large sums of money and never paying back). Mom's attorney feels this is iron-clad, but my sisters are threatening to get an attorney and either challenge the will or sue me to get me to give them money. Do they have a case? Thanks

It depends on the circumstances surrounding the making of the will. More info is needed. In general if all of the formalities of making a will are followed and the will is drafted by someone who is knowledgeable in wills/probate then the chances of a sucessful challange are slim. But, as I said more info is needed.

Mom's Will

Thank you for the response. The will was drafted by an attorney who specializes in estates and wills. It was duly signed and witnessed by himself and another individual. In addition, my mother had on many occasions stated to her attorney that these were her specific wishes. She also made these wishes clear to a second attorney, one who handled elder care issues for her. That second attorney also tells me that he is confident that she kinew exactly what she was doing. I understand that challenging a will in New York State is extremely difficult, but I just want to be able to rest easy. thanks again.
