My brother was married in the State of Idaho in 1997. A marriage ceremony in front of witnesses was held.
Both copies of the marriage license were signed by all the necessary parties. After the marriage, the bride took custody of both copies of the marriage license and promptly lost them.
It's now four years later and my brother is on the verge of divorce. Nothing was ever filed with either the State of Idaho or the County Court recorder's office. Is he legally married? Or has he just be cohabitating?
I know for a fact that Idaho has a one year time limit on the filing of marriage licenses. Can he just walk away from this marriage or does he have to file for divorce?
