Is my marriage legal?

What is the name of your state? North Carolina

My husband was married previously in the state of PA. He divorced in the same state. When we filed our marriage application he could not locate his divorce certificate which I thought was odd at the time, but dismissed it. Instead, he stated on the marriage application that he had never been married.

I have two questions. Does that in any way falsify our marriage? How can I determine if he is indeed divorced from his ex-wife?

I am beginning to prepare for a seperation/divorce and would like to see if I have additional grounds.

Although he committed a fraud on the face of it, his lying on the marriage certificate is not, in and of itself, grounds to have the marriage nullified.

You need to find out in what state and county he was divorced. Then contact the court clerk for the file.

otherwise, you'll just have to trust what he says.
