This guy that sold me a business started another business that would come into the area that he was not supposed to be permitted to go into. The agreement states that he had to be hired at an agreed upon rate (which I did not catch in the agreement until later on). The thing is, when he sold me the business, he lied to me about debt and another person involved with the business. He also tried to blackmale me and overdrawed the account which led to him wanting to sell out to me. Since I should not be expected to hire someone that lies to me and ripped me off, can this non-compete clause still be enforceable? It states that he was not supposed to startup another business within five years and it is within that five years.
