Is My School Breaking The Law?

What is the name of your state? New Jersey.

Personally, I would think so, but I would like the help of others. If possible, I would like any links and such to actual law snippets where I can see that its in the law.

I am a Senior in High School. Of course, fellow classmates have done some "underage drinking" here and there, but nothing on school grounds. There is a website on the internet called MySpace. Its pretty much a blog, where you can leave comments, add pictures and friends, and repeat. Its just one large teen discussion forum in blogging form. Moving on... Everyone uses MySpace to show others their pictures. Some people have put up some pictures of themselves either smoking something or with some type of alchohal. Some were using them, and some werent. Anyways, a teacher at my school registered an account on MySpace and searched through them, finding a group of kids from my school. She went and told the principal about the site and the pictures, and after the principal viewed them... the dirty work happened.

In one day, there were 37 Suspensions.... Yes, that exact number. 37 suspensions. All from 5-8 days. All that were suspended lost privelages to next weeks Christmas Dance (which many were looking forward to and have spent lots of money on; for seniors, this is their last christmas dance). Another thing... If you are a senior, 10 days of being suspended automatically fails you for the year and you have to do the year over next year. I feel sorry for the few who got 8 days of suspension.

Isnt this illegal? I thought public schools cant do anything out of their reach... and seeing how this is the internet, and the people did it at the comforts of their own home... what gives? And yes, that is the reason they were suspended. Nothing more.

Please help. :(

I am not going to comment on the ignorance of the student's actions.

However, the court has already spoken on the issues of off-campus actions and the school's reach.

First, answer a question: Is this public or private school?

Its a public school. Though the students did something illegal themselves, I still feel its something that the school shouldnt get involved with, since it was done at home. You know what I mean?

First of all, keep your 'feelings' where they belong....private. This has nothing to do with feelings.

Second, if you know the students then tell them to go as a group to a local attorney and seek a temporary injunction against the school requiring reinstatement until such time as their lawsuit against the school can be heard.

There are several recent cases that their attorney will use as grounds for the suit, one being Robert O. Marshall v. Roy Hendricks.

As for your ORIGINAL question of whether it was legal, this is not legal or illegal. It IS, however, actionable.
