Is Nepotism Legal??

What is the name of your state? CAIFORNIA

My wife works as a real estate agent in California, her commission is based on how much real estate she sells. The more she sells the higher her commission on the sale. Currently her commission is set at about 80%.

Recently she discoved from a friend of hers who used to work in accounting that the General Manager's son, also a real estate agent in her company. was being paid his commission at a 95% rate. The same rate his father the General Manager is paid. Not even the number one agent in the company is paid 95%. The son in question is not even close to the top sales agent.

Naturally my wife and a few other agents are upset as she has worked hard to get to her current rate.

Does she and the other agents have any legal recourse here?? Is this type of nepotism legal??

She doesn't have a problem with them hiring the guy, but shouldn't the company's commission schedules apply to him as well? Is there no limit to the amount of pay / benefits they can give the guy as opposed to the rest of the employees?

Should the company treat all people the same? Of course they should. Are they obligated by law to? Hell no.

Nepotism is legal. If they wish to offer a family member a higher salary, commission schedule, or benefit package, they may.
