We initially enrolled our 3 year old son in a special education preschool over the summer (he was supposed to begin the program at the end of August). He is considered on target for his age by his Dr.'s. He was only approved for services because we adopted him (came into our care abused when he was 3 months old).

We decided not to send him there for two reasons. 1. We were unable to get him to and from the preschool because I work & my wife goes to college F/T, and the times clashed with our schedules; and 2. A couple of days after he was enrolled, one of our son's birth relatives told us that they heard that our son was going to be attending this certain special ed preschool. We decided to keep him in the preschool/daycare that he attended last year, and my wife called the special ed preschool to let them know that he would not be attending.

When my wife picked my son up from daycare today, the director said that someone from the special education preschool contacted her and asked her if he was attending there this year. She said that they would like to come out to the daycare tomorrow and meet with my son. They also asked what time my wife normally pick him up so that they can speak with her about giving him services. After she got home, there was a message from the special ed preschool saying that they will be sending someone out to meet my wife at the daycare tomorrow when she arrives to pick our son up.

I am furious that they contacted his current daycare and discussed my son, as well as my wife's schedule! I feel that our rights were violated! We did not want our current childcare provider to know that he was going to get special education services!

Is this legal?!?!?!

Inform the daycare that they are not to talk to the school.
