Is it a crime to take a photograph of someone without their permission? Not a celebrity or politician, I'm talking about a regular non-celebrity john/jane doe. My car was smashed into and I just wish I had a disposable camera to take pictures of the damage and the other driver. I was wondering if the other driver could sue for damages if I took her picture to keep in case I needed to show it to a lawyer or insurance company or whatever.

My response:

No, it is not illegal.

The only time it would be "illegal" is if you were to use the "likeness" of a person, without permission, for commercial or other pecuniary advantage or profit.

An auto accident does not fall under such rules or laws.
