washington state,our house is on the market and is shown by appt. only. we went out of town fri.6/29/01. i called the real estate office to let them know they could show the house any time from fri. 6/29/01 till tues 7/3/01. an agent showed our house 6/30/01-left her card and msg. on our machine.now to the problem...anytime we go out of town we close our bedroom doors since we have 2 indoor cats and we don't want them sleeping,playing,etc on our beds.our cats have never been outside and never used anything but a litter box.when we arrived home the evening of 7/3/01 we discovered the door to the bathroom/utility room closed,and that happens to be where their litter box is located.On the other side of that door were our cats! they pooped and urinated all over our 2 yr. old $3000 leather furniture, our braided rugs, our ceramic tile floors...you get the picture. i called the listing agent and informed him of the problem,he said he'd call the broker to see if they could "help" in any way...no call back as of yet.our homeowners insurance denied the claim as i thought they would.a cleaning co.came and sprayed the furniture but it still reeks.is there any way to hold the real estate co liable for this?

Not unless you have a clause in the contract that makes them liable in the event that anyone (even another showing agent from another broker) leaves that door closed. And that is highly unlikely.

It is common for agents to include 'special conditions' in the MLS listing, but this is not a contractual obligation.
