I would like to propose to my girlfriend. We both live in Colorado...but, there may be one little problem. Is she married or not? Prior to the beginning of our relationship, she lived with someone for two years. They filed joint tax returns, but were never married. Is she required to seek a divorce before we can marry?

A common-law marriage may be established by proving cohabitation and a reputation of being married.
