Hi, can anyone help me? I am the owner of
an apartmernt. Few days ago, my car
which was parked in my parking stall was damaged by
the person that parked adjacent to my stall. Since I
have no witnesses and no proof as to who is
responsible, I have to burden the cost of the repairs
which I got an estimate for $500-$700. I was told
that the resident manager forgot to insert a video
tape into the secuity system that monitors the parking
lot. Therefore, the incident was not recorded and I
have no way finding out who is responsible for the
cause of the damage to my car.

I already filed a claim with my car insurance
provider. Although my car insurance will cover most
of the costs of the repair, I still have to pay the
remaining amount. For my situation, are the AOAO liable to some extent and will I be able to file some kind of claim with the AOAO?

This is one of the things you buy insurance for. And you chose your deductible. I am sure there is a park at your on risk sign or policy. The guy who got in next to you would be liableif you found him.

The apartment managers should not have any obligation to you for his actions, nor for failing to have a VIDEO-TAPE IN THE SYSTEM. THE TAPING IS NOT INTENDED TO HELP IN 3rd party DAMAGE CLAIMS. THE LACK OF TAPE DID NOT CAUSE THE INCIDENT.
