My husband and I have been separated 2 1/2 years. I moved out. I know that California is community property state but here is the stickler. My husband purchased property from an old friend. The property should be close to being paid off and my husband has never paid all the escrow fees to get the property in his name. He pays the taxes though. Can he avoid splitting the property with me because of it not being in his name?

Even if the property is not in his name, you as the spouse can claim an interest in the property, provided he has interest in the property. Even if the property is not in your husband's name, he is said ot have an equity interest in the property. Especially if he bought it under a contract for deed or land sales contract method.
If he keep his name out of the transaction to purposely evade having to share the property with you, he may be surprised to learn that Community Property laws protect you.
