I'm trying to figure out if there is such a thing as an 'extreme' or 'aggravated' DUI charge in the state of Michigan (based on the BAC). Does anyone know?

MI will kick your ass on DUI.

I live here and they pound everybody.

Once you are able to get your DL back, on top of all of it, they hit you for $1000.00 per year.

For two years after you get your DL back.

If you get any tickets, they just extend it, and it is another $1000.00 per year

Now this is above and beyond the DUI stuff.

They call it Drivers Responsibility Fees

MI will kick you up and kick you hard.
 
Yeah, that driver responsibility act is a pain... I went through mine about four years ago.

I'm asking this time around because of a friend who was picked up while driving with a .16 BAC. I was trying to give him advice, but that's a quite a bit higher than my BAC back then and I wasn't sure if additional penalties might apply.

A third drunk driving arrest, OWI causing an accident, or OWI with fatal collision can result in the aggravated or felony status.

The prosecuting attorney will probably offer to reduce a charge from OWI to OWVI (operating while visibly impaired). There is not much of a difference between the two charges, and they both count as a drunk driving conviction. One possible difference is the "reduction" may be designed to encourage people to waive the right to contest the evidence.

Elevated BAC does not appear to change this to aggravated though. It can affect penalties the judge hands down.
