In early June a teenager molested my six year old daughter. The State Police investigated the incident, but the boy lied and his mother covered for him, so they dropped the investigation. There were two children who saw him force her into the woods, but they never spoke with those children. They only spoke with my two children and him. I doubt there is any way to do anything about the way it was investigated, but if anyone sees any options for getting the investigation opened again, I will do as instructed.
Since the investigation has been dropped this boy has gone out of his way to taunt my daughter. He has done things such as hiding around the corner of my apartment building so that I could not see him, but my children and their friends could see him, and makes faces at her, grabbing his crotch and flipping her off. I quit letting her play outside at all after he started that and we invite her friends over to play so she has interaction with other children. I called my attorney when this started and he said that he would talk with the police and it would be taken care of, but nothing ever happened.
On Wednesday afternoon, she and I went to check our mail and on the way back, he and a friend of his came around the corner. He stopped and glared at her, and she started crying and hiding behind me so I told him to leave my child alone or he would have to deal with me. He mumbled something and walked off. I was somewhat aggressive in my tone, but I wanted him to know that I was serious. Then I took my daughter home and calmed her down. Later in the evening, his mother and a gaggle of her friends knocked on my door. I answered it and she started yelling at me. I told her that I was not going to deal with her and that if she believes I did something wrong she should call the police, then I shut and locked my door. She stayed on my porch, yelling at my closed door for a few minutes, so I called the police. She left while I was still on the phone, and she called the police too. They said that they would get an officer out here to talk with both of us.
The officer said that there was really nothing they could do about him right now, but they would make a report. They told him to stay away from her and told his mother that there was nothing illegal about me telling him to leave her alone. They told me that there was nothing illegal about him doing what he is doing at this point, but to keep making reports when he bothers her. They said that in my state, restraining orders do not exist any more. They have Orders of Protection, and those only apply in cases where the people have lived together.
I took on extra work so I can save enough money to move, but it is taking longer than I had hoped. Are there any options for helping her right now? This has turned a very good child into someone entirely different. She is having trouble in school now, her behavior has been horrible and gets worse every time she sees him. I have put her in therapy and I spend my lunch hour at the school, reading to her class in an effort to help her. The school has been wonderful and has really worked with her, but she is still struggling.
If there are any legal options I will follow through with suggestions. This has been a nightmare for us. Would it be possible to reopen the investigation because they did not talk with all of the witnesses? If it is not, is there anything besides an Order of Protection that might be used? In order for harassment to be claimed they have to establish a pattern. How many incidents does there need to be before a pattern is established? I would rather she did not have to face any more incidents at all, if that is possible.
