The company offers an extra week's vacation to those employees who have been working for them over 5 years. The policy manual was never clear as to when the extra week goes into effect (ie: at the employee anniversary date or the beginning of the year). In JANUARY, they gave those employees of 5 years the extra week of vacation. It was put in writing. Now, NINE months later, they are taking it away! They claim they made a mistake in giving it to us. Those who have already used it - the vacation will be deducted from next year's vacation. To "be fair", they said half could be deducted in this year and half deducted next year. Can they do this?

They can unless you have a bona fide, binding and enforceable contract that says otherwise.

FYI, in the majority of cases, an employee handbook is NOT a binding contract.
