What is the name of your state? California

Our non-profit club wants to use a picture of the Cat in The Hat on our flyers advertising our "Book&Bake Sale", proceeds which benefit our local library. Is this a copyright infringement? Thx~chris

Yes. Many companies will allow the use of images gratis for charitible causes. Give Dr. Suess a call.

Thank you for the reply. If the owner of the copyright is dead, does that mean I can use the graphics?

No. Unless the copyright is expired or the work has been expressly given over to the public domain, somebody owns the copyright -- its property, so it can pass to an heir, or be sold to somebody else. You would need to find out who currently holds the Seuss copyrights, and ask them for permission. If the copyrights are registered -- and they probably are -- you could try and get more information on the current owners from the US copyright office.
