My property and neighors property have adjoining and attached porch roofs (no open space in between). In 2006, I had the entire porch roof taken out, down to the decking. replaced rotten decking and a new porch roof put in. Befor the contractors could start work, they had to sweep standing water out of a 2x2 puddle on the neighbors side.During replacement, you could see water seeping out of the 5 inches of tar and paper on neighbors side.In 2005, I had to replace the support column that hold up the 2 porches because it had rotted out. After replacing the column, the leak continued. This same was leakage from rain/snow/sleet that caused me to have to replace my soffit and fascia in2001. When this was done, I also had my roof re-papered and and re--tarred. The soffit and fascia was also covered the vinyl. Currently, the vinyl is peeling off in the area behind the downspout because of water leakage. Prior to this, in 2000, I had another contractor come out and put down a rubber roof, with a blowtorch and tar . The porch roof continue to leak around the downspout area, but not in other areas. The contractor said the leakage was coming from cracks in my neighbors roof. Prior to this, (1999) I had a (3x3) area around my downspout cut out, and removed rotten board underneath. I replaced rotten board with new wood and the whole porch roof repaper and retarred. The porch roof still leaked. The contractor said the leakage was coming from cracks in my neighbors roof. Each time I talk to neighbor about the roof, he will either say it doesn't bother him or he will put some mor tar or tar&paper on it come spring. The last time he said he has done all he knows how to do, to fix his roof. Neighbor had a downspout on his property, but he had it taken out when the neighbor on his right fixed his porch roof and replaced downspout with a gutter system. My neighbor has slanted his roof with many applications of tar&paper (mostly cold tarout of a bucket) so that water on his roof will drain to my side. It doesn't drain, it sits in that puddle and leaks down my new column. Any information or advice will be greatly appreciated. Baltimore City.

Unless your legal quesiton is in your title.

This is an issue between you and your neighbor. Your insurance policy does not cover excessive wear and tear or lack of upkeep of your neighbor's roof.
