I live in Arizona and on 7/12/00 I purchased a new Motorcycle from a dealer. At the time of signing the contract in which he sold me the motorcycle for $33840.00. I ask him about the down payment. He said that these are only numbers and the only down payment he needed was $250 in which I paid. But the contract to the financial institute stated that I had paid $6,150.00. Would this make the contract void? When I quwestioned them they thought that I had put down the large sum of cash for this motorcycle.

You know two things: (1) the dealer lied to you, and (2) the dealer lied to the finance company. It is possible that you could end up liable to the finance company because you know about this. I don’t know how likely that is, but it is possible. To protect yourself, I would advise you to tell the finance company what you know about this.

I think the contract is not void, but it is voidable by the finance company, and maybe by you.
