Is this discrimination?

I work for a successful and profitable division of a very large company. We were #1 in corp. last year. So, no issues with performance, good annual reviews been with them for 5 yrs. I have applied for 2 promotions in the last three years. In addition, a co-worker of mine has applied for the same positions, he has 9 yrs. exp. here.

Obviously, we did not get the promotions. Both positions were filled from the outside of our facility with minorities. I have no problem with this at face value.

The two issues I have with this are:

1. The company I work for has a "reward" in upper managements annual rewiews (which is tied to bonuses and raises) for hiring minorities. I think this leads to discrimination.

2. The company also has special leadership development program in place. I found this out after being turned down for my last promotion. The person they chose for this position is in this program. I thought thats fine, and I requested that my manager allow me to participate in this program. He said that would not be possible because I didn't fit the "profile". I asked him what that "profile" was he said I had to be either a woman or a minority.

I understand how important diversity is in an organization, I also believe the most qualified person should get the job regardless of their ethnic backround, gender, or any other group they might fall into.

Is this discrimination?

On the face of it and based solely on your post, I would think so. However, to have enough information to proceed further you would need to consult a local employment attorney.

How do you know that you were more qualified than those selected? Usually, qualifications turn on factors other than length of employment.

I understand, and agree with you about length of employment ect. Neither of these two people had ever been to our facility prior to interviewing with us. There are only two facilities in the world that do what we do. Therefore neither could have more experience, or know our processes better than we do, but that really doesn't matter. We were told why they were hired, instead of us. To bring more diversity into our facility.
