Is this Harassment?

What is the name of your state? Oregon

I am currently dealing with a situation regarding my girlfriends day care provider. In the month of May she worked a total of 30 hrs. and wants $410.00 for her time. She charges $630.00 for the entire month. She is choosing not to budge (stating that they already spent that money) on her figure for the hrs the children were watched.

Her husband is now calling friends and family leaving messages and telling anyone who answers that we owe them more than $410.00 and that he is going to take both of us to court over the matter. The only reason for them having these numbers is in case the children are ill or there is an emergency, not for collection purposes.

We don't have a problem paying for one (1) weeks worth of service, but don't feel we should pay for services not given. This wouldn't even be an issue if we still used her services. However we are moving and no longer need her to watch the children in her area.

So what I wish to know is this. Can he call and give this information to 3rd parties without our say so?

I would appriciate any advice on this matter, what recourse we may have or if i should post this in a different forum.

It depends on the contract your g/f agreed to. Most daycare providers charge for the month, regardless of how many days the children actually attend- You pay for the space more than anything...ie; the provider can't watch other children since there is a legal limit, so it is a way to stabilize income and assure a daycare spot for the child. If the agreement was monthly- Your g/f owes her the $. If the agreement was hourly- Your g/f only owes for the amount of hours she was in daycare.

Your family members can advise the woman not to telephone their home anymore- and she should stop. If she doesn't, they can take out a restraining order against her...but until they tell her to stop, and she continues, a restraining order won't be issued.

The bigger issues is your g/f is at risk of a small claims court filing that the daycare provider will likely win.
