Not sure if this is the right thread to put this in....

I have a camping trailer that has been at the same park for 3 years, I have always been a seasonal camper paying for the whole summer. During the winter everyone leaves there camper up there.

Well this year the weather was still nice and i decided to stay up there for a few extra weeks after the season ended. We agreed on a price of $20 per day with the owner of the campground.I stayed up there until the 13th of Nov. then went back to my house for the winter. before i left i talked to him and he agreed and acknowledged that i would be leaving on the 13th.

I came home then left on the 14th on a business trip and came back on the 26th. When i got home i checked my messages and the owner of the campground called me about 8 times saying i owe him $20 a day up to the 26th and was acruing daily. I called him and he said that because my camper was still hooked up to the sewer line that he considers me still there and i owe him more money. I payed him until the 10th of the month before i left because i wasnt sure what day would be my last (which turned out to be the 13th).I agree that i owe him the $60 for the 10th -13th but as for the other $260 (14-26) i dont think i owe him it.

I went up there today (26th) to pull my camper out of the park and put it at my house for the winter and find another park in the spring. When I got up there he had his tractor parked in front of my camper so i couldnt hook it up and pull it out of there. I asked him to move it and he said he wouldnt until i payed him the full amount of $320. I called the police and they said it was only a civil matter and i have to take him to small claims court to get my property back. I almost went back to the park to make it a criminal matter by slapping him upside the head but decided it probably wasnt the smartest thing to do.


Can he legally do this?
what can i do to get my property back?

Well "pay it and consider it a lesson" doesnt really answer my question. So your saying I should just lay down and let him screw me and everyone else that does something similar?
Wow thought this was a free legal advice site?.....I hope i dont ever hire an attorney that thinks the way you do.Maybe I just have to much pride to just lay down and let someone stick it to me like you would do.I work hard for my money, Im not about to give it to someone that didnt deserve or work for it. maybe Ill just call a real lawyer and see what he says.

Fine - call one and he'll tell you it's not legal and that if you pay him a $1,000 retainer, he'll work on getting your trailer back.

Or, you could simply pay the $320 and be done with it.

Any way you look at it, you owe the $320...but, hell, it's your money - throw it in whatever firepit you want, we don't care.

Although I agree with your position, I am unable to offer you any sound, legal advice. I doubt that you actually received any true legal advice here, however. It is probably true that paying extortion to the landlord is the cheapest way out. However, it still remains extortion. You could file, as the police said, a claim in small claims court against this person to make an attempt to recover the difference, but you have to place a value on the time out of your life that it takes. The victory would be small and insignificant. Stressing over it will reduce the quality of your life, take a toll on your health and likely keep you sleepless at night, particularly should you be denied i your claim. While this person likely feels that he's right, just as you do, you are better served by taking this as a very cheap lesson (believe me, there are much more expensive lessons) about covering all your bases and leaving nothing to chance in future endeavors.
