Mississippi.My husband took some survey on line and now they are sending magazines we did not order and taking money out of our bank account for payment for the magazines.Unfortunatley,my husband gave them our bank card number(for verification,so they said).When we contacted them about this,they told us if we pay them $198.00,they would cancel the subscription.Can they do this ,is this legal? We did not agree to this,verbal or otherwise,nor did we give permission for them take money out of our bank account.

Call your CC company and cancel the order immediately. Explain the ruse to them.

Next time your husband sits down at the computer take his wallet away and blindfold him. You have permission to kick his butt for being so stupid.

"...for 'verification'...". Good grief! Are these porno mags?

The company wouldn't by chance be Omnipresent Inc. would it? I am having a similar problem.

They got me too and after repeated attempts to cancel the order for magazines. I even cancelled the cc that I used. They called me again and asked why was payment refused. I told them again to cancel the account/order.
I tossed any documentation I had figuring it was done with. NOPE, they sent it to Academy Collection Service, INC. who told me that no one had reported recieving anything from Omnipresent and that only people in the middle of buying homes have bothered to pay. If you have a telephone number please provide it. I would like to see if I can get some poking around done.

Omnipresent Inc. got me!!

I received a call today from a woman representing Omnipresent Inc. in Florida informing me that I had won a sweepstakes sponsored by one of my credit cards, Visa, Mastercard or Discover and that I am eligible to receive 5 magazines for the cost of 1, to receive a mens or ladies watch valued at $50 to $55 and I would be entered in a drawing to win from $100,000 to a million dollars to be determined on Dec. 31.

I immediately asked "what's the catch?" she said "there is no catch." I asked " how much does it cost?" she said "there is no cost." So, I proceeded to select 4 magazines, 2 for me and 2 for my wife. She then informed me that her supervisor would call me to verify how she had presented the information and if she had informed me correctly.

I was quite ecstatic over winning a sweepstakes and getting some free magazines and a watch for my wife, not to mention the drawing for big bucks.

Five minutes later the supervisor called to reiterate the previous information and if the original caller had done a good job. I said she had. He then asked me to verify my debit card number and expiration date, which I "STUPIDLY" did. He informed me there would be a nominal fee of $3.36 per week for all 5 magazines, which would not be charged until Jan. 03, 2006. I said ok, thank you.

Three (3) hours later I checked my bank online and discovered a pending transaction for $38.83.

"AWW SH**" I exclaimed, "he said they would not charge me until January, he lied."
Now my wife is yelling (rightfully so) that I should know better than to give my card number out over the phone.

We are unable to stop the pending transaction, but we cancelled my debit card. Why is it called a pending transaction if you can't prevent it from happening? The bank should look up the meaning of pending.

Short story, long post.

My question is? Does anyone know how to contact Omnipresent Inc.? They said they were in Florida, but the debit is from Magazine Inc. in Virginia Beach, VA. I would like to try to cancel the order.

Any help would be greatly appreciated. Any info I find out I will pass along.

Can they do it?? Of course they can... they did, didn't they??
Is it legal?? Based on your post, yes. Your husband apparently (stupidly?) gave them permission when he gave them his bank information.

As noted above.... you did.

And before ANYONE can even offer assistance, we need more information... for example, were these charges made by debit card, credit card, bank draft, etc.???
Each of them has different laws and possibly legal actions.
Also, it might help if you were to provide some information on the company so that we can do a little research.

Will await your responses before offering any advice.

As for all you others who have tried to hijack this thread from the original post.... start your own thread and we might try to offer some help.

So, I had that same thing happen to me just yesterday. Some woman called me about magazines and such and some sweepstake and then her supervisor called up a few minutes later. I was headed to a dinner party and he was talking and needed to "confirm" my debit card number and in order to "confirm" which means that they already are supposed to have had it, I did. After confirming he tells me the costs and I told him I couldn't afford it and didn't want any part in the deal. He then tries to haggle me and I again tell him I didn't want to have a part of the deal. I then got distracted by one of my friends and finally ended the conversation with the idea that I had told him no and there would be no further events with that company. Later last night, I got online to check my bank account and there were $58.27 taken out of my checking account from a place called "Magazine Inc" in Virginia Beach, VA.
This morning a man calls and asks if I talked to those people last night and I said yes and told him how I said no and that I didn't want it and I couldn't afford it and how there was no number to call them back at. He said he'll talk to the financing group and call me back later...which I highly doubt will happen. I'm not sure what to do.

I understand your dilemma but older threads are usually dead and recieve liitle response. Start new thread all your own to get specific advice on your situation. :)

Wow isn't that something I am having the same similar problem and they have now sent it to their collection agency and now want me to pay 790.00 and not get any magezines after I told them that we didn't want the magazines. They originally said that they would cost like 12.00/mo then we get this bill in the mail for this outrageous amount of 790.00. How does one resolve a matter like this?:confused:
