Sorry for the length. But here is some background first:

3 years ago my husband gave his boss his 2 weeks notice. Before his 2 wks were up, he boss cursed him out in front of customers. He told her she couldn't talk to him that way and quit and he walked off the job right then and there. He called his district manager right away and set up an appointment with him. My husband was told that he was fired for walking off the job and that he should've called him before walking out and my husband told him he didn't care what they called because he quit.

Recently my husband was arrested because he missed a court date that he was never served for (they had the wrong address) because this boss filed a complaint with the local police stating he made threatening calls to her that began after a month after he left at about midnight everynight for about 3 weeks. This is BS because he was home every night and all phone records can prove that it is false and that there were never any calls made. We feel that this is retaliation for walking out and leaving her alone in the store and everybody quit because of her.

Anyway, we just received a copy of the complaint which states that my husband was fired from another store in which he never worked. Is it legal for a supervisore for a company to release this confidential information? Does my husband have any recourse?What is the name of your state (only U.S. law)?

First., it is not confindential info and what info are youtalking about since you claim he never worked for the store she said he was fored from?

Does my husband have any recourse?
recourse for what?

It seems he needs to deal with the case at hand, you know, like the one he was arrested for.

btw; I undserstand the service (of summons ) requirements are quite lax in NY so you need to lookl into how he was supposedly served before. IF he was not served properly, then he can argue against the warrant for defective service.

It still will not clear up whatever the main situation is but it will help with the arrest.

That doesn't make any sense. The boss can't file a criminal complaint on behalf of an employee who was threatened/harassed. She'd have to do it herself.

This is BS because he was home every night and all phone records can prove that it is false and that there were never any calls made. I'm not saying he made the calls but he could have used a prepaid cell phone, a pay phone, or made them from another location such as a local tavern. All your home phone records show is that he didn't make the calls from there.

We feel that this is retaliation for walking out and leaving her alone in the store and everybody quit because of her. Even if that's true, it's not prohibited retaliation. Plus this all happened three years ago. That's an awfully long time for the boss to be pissed-off.

Does my husband have any recourse? Sounds like your husband needs an attorney.
