What is the name of your state?CALIFORNIA
Is tiered child support common in Ca? My friends going through the start of the divorce process and his STBX is asking for "tiered child supprt. The kids are 15,13 and 6. She wants 600.00mo. for the 15 yr.old, 1000.00 for the 13yr.old and 1500.00 for the 6 yr.old.
I KNOW he needs a lawyer.........I already told him that. But what is with this support deal? I have not heard of this before?

Nope...the parent can not set "price tags" on the children. The parent should be ashamed of themself for even thinking up such a stupid plan. It should be factored according to state guidelines.

There is nothing in California law that says she can't ask for such and nothing that demands he pay.

Child support is dependent upon many factors. It's something HIS attorney needs to deal with based on all relevant facts.

so, she wants $3100 PER month in child support??
Yeah right.

She will get about (I say about) 27% of the combined parental income.

Typically, it is "about" 17% for child #1, 21% for #2, 27% for #3 and 31% for #4 and so on up to about 40%.

Other things do factor in, but SHE Is not going to "pick" how much she will get.... this will be decided by the Judge presiding over the case.

Thanks............. she actually wants a total of 5000.00 per mo. with spousal support !!! He makes approx. 180,000.00 a year. But he is in the mortgage business and his income has been steadily dropping for quite a while due to the home sales/economy in our area. Will that factor in?
Anyway, so I got conflicting answers. I thought when child support was ordered it was usually the same for each child (unless there was a special circumstance ie. health issue etc) I have never heard of anyone getting different amounts for each child??
Can someone clarify ? :eek:

You did NOT get conflicting information. I simply said she can ask for anything. That is the truth. What a JUDGE orders is another matter.

And $5,000 is not an outrageous amount. That's the exact amount I pay in Child support alone for two children.

WELL THEN YOU MUST BE A LAWYER !! NOT MANY PEOPLE PAY 5K IN CHILD SUPPORT FOR 2 KIDS. :eek:
