My cousing had filed for a no asset under the old laws, had her 341 meeting, the whole nine yards. She had a vehicle that was involved in a serious hit and run accident. Her insurance paid out the max but that was still not enough to fix the vehicle as well as her medical bills (crappy insurance). The vehicle still does not run and has physical damage. the finance company which she was making payments to had the automatic stay lifted, and it seems an outside company (She has the name and phone number of the company from her caller I.D.) had contacted her about picking up the vehicle. She talked to the outside company, they stated they were going to be picking up the vehicle on behalf of the finance company and to make sure that everything of her's was out of the vehicle. They came to her household last night, asked her if anything is in the vehicle, she stated the keys to the vehicle were, basically put the car on the tow truck and drove off! Didn't even give her the chance to say rarely anything. Now I know this happens everyday when people don't pay there car payments they can come in the middle of the night and take the vehicle without your knowledge. She didn't even get a piece of paper, nothing! A buddy of mine states they can do that, they really do not care as long as they get the car back...but can't they turn around and say we never got the car? I am just confused with the situation. Any advise would be appreciated :eek:

What could she say that makes once speck of difference to the repo guy ?? They don't care about any stories, their job is to pick up the vehicle - period.

They do whatever it takes to recover the vehicle without breaching the peace. I seriously doubt anyone who's behind in payments, who's probably had ample notices from the bank to pay up or lose the car, can say they're really surprised they found the car gone one morning. C'mon - they know the car is going to be repo'd, one way or the other the repo man usually wins.

What piece of paper did she expect, a receipt ?? She WILL get notice when the car is sold at auction, how much it sold for, and how much she owes. In her case though, with the BK, she will owe nothing, but the notice is required by law.

No, they can't. Where would that get them ?? These guys make their bread and butter thru the finance companies, if they want business, they can't go running off with the vehicles. The BANK expects the property back, and I'm sure there are papers the repo guy must provide to the lender showing they got the car.
