is this slander if 'not' said in public ?

I had ordered a computer online, it came damaged . i had wanted to send it back for them to fix, but they waned to send me parts to replace myself. after 2 /12 weeks of back n forth nothings. i told them " i was having it shiped back , either1 repair/replace/ and send back , or 2 , refund my moneies. At which they said they would refuse to accept without an RMA. in any case. at 1st , thy claim all this damage was due to shipping [ which i had told them it was not shiping damage] ,then , they said "had broken it myself and was trying to screw them over, and nothing further they can do to help me .."
I had asked , "who you folks going to blame next , ? 1st FedEX, then i broke it , what next ? it fell off Santa's sleigh " . . which i guess did not amuse them . :}
this was all in Emails, not in public . is this still a slander ?? i guess that is my question , the statment not being made in public ..after they had said that to me .
To date . they have not refunded any monies, or replace the computer, going on 6 weeks now
can i sue for any thing on this ? thank you for your time on this silly thing.

There's nothing defamatory in what you described.
Dispute the charge on your credit card...

I agree with Zigner.

Plus, had there been anything defamatory written in the emails, it would be considered libel, not slander, as slander is spoken defamation and libel is written defamation.



(Santa might consider it libelous, as you were impugning his skill in delivering packages - but courts have ruled that attributing one instance of clumsiness is not reputationally damaging, as everyone makes mistakes, so any suit brought against you by Santa would not be successful.) (but look for coal in your stocking) ;)
