What is the name of your state? Mississippi

Could I be suied for my opinion below. I posted this on another message board that belong to a Former county Board of Supervisor. Some people on the other BOS message board are saying I have crossed the line. The guy I was talking about is a man running for office of Mayor in the next county.

I have heard worse from people talking about politicians.
Why am I different. What is the jail time for this because I'm broke.

Some of you always tell me to question what I see or read in the news. Well, I happened to see something that has scared me, and it comes from Metro City. John D (The Former TV NEWS Manager) is planning to run for the Office Mayor of the City of Metro City. I hear alot of people say he is a drug crime boss.

Now you maybe wondering why I'm soo concerned about John D. becomeing the Mayor of Metro City. What does Sparta County has to do with Metro City's problem.

If what people are saying is true then John D is going eliminate the competition of illegal drug sales in Metro City into his own monopoly. This means all the illegal drugs sale will shift toward the suburbs. That includes Sparta. Just watch the news and see when the next drug dealer is arrested because of John D.

We need to keep a close eye on Metro City. You might think I'm off my rocker but I'm not. I'm just questioning the things I see in the news like some of you tell me to.

Sorry, but Krispy is wrong on this one....
Unless he is trying to be cute about the difference between slander (oral) and libel (written) defamation.

The problem you have is that your statements would lead someone to believe that the person is a criminal or involved in criminal acts. That is prima facie evidence of 'libel per se'. Libel per se involves statements so vicious that malice is assumed and does not require a proof of intent to get an award of general damages.

defamation
n. the act of making untrue statements about another which damages his/her reputation. If the defamatory statement is printed or broadcast over the media it is libel and, if only oral, it is slander. Public figures, including officeholders and candidates, have to show that the defamation was made with malicious intent and was not just fair comment. Damages for slander may be limited to actual (special) damages unless there is malice. Some statements such as an accusation of having committed a crime,... are called libel per se or slander per se and can more easily lead to large money awards in court and even punitive damage recovery by the person harmed.

Finally, whether this is or is not defamation should be the least of your worries. Simply by bringing a civil claim against you for this (and it sounds like this person likely has sufficient funds or backing to do so) and forcing you to pay the cost of defending yourself should be enough to cause you to rethink your 'position' and stance.

I think you hit this one out of the park Jet. From my position as a casual observer for a time on this forum I've found that at times, Krispy's tongue is planted so far into his cheek that he can't help but to bite it at times :D

You're right. And since I'd be running the risk of following in the footsteps of contributors like CharlieAngle, LYLE and Eber-whomever, I guess I'll just say that Jet is correct and this poster, although asking the wrong question, received the correct response to the question he SHOULD have asked.

Since I have observed before coming to light on this forum, and you are one of the few whom I have respected during my observations, I won't ask what you mean by those remarks.

After all, there are some things not meant to be understood by minds in flux. :D
